The ACLU of Kansas & Western Missouri's board is meeting tonight to discuss representing Jonathan Justus, owner of Justus Drugstore in the case brought against him by the Missouri Board of Pharmacy.
Justus received a cease and desist letter for the use of the word drugstore in his restaurant name, and the ACLU recently contacted him to say the organization might be interested in picking up his case.
Justus said that there’s been some discussion in the ACLU over whether or not to file on behalf of a commercial business but that even if the ACLU declines to do so, ACLU of Kansas & Western Missouri President Bill Raney and fellow ACLU member Steven Streen will accept the case pro-bono. The goal Justus said is to resolve this as soon as possible.
"The Missouri Board [of Pharmacy] is hell bent on pursuing this…but I just want to nip it in the bud before it goes to trial," Justus said. "I’ve received over 300 positive e-mails, and my legislators are working on behalf of us. It’s incredible the support.”
Justus expects to hear a decision from Dan Winter, executive director of the ACLU chapter, sometime tonight or tomorrow. Winter was unavailable for comment.
When asked what he’ll do if he has to balance a lawsuit and a restaurant at the same time, Justus sighs before answering, “That’s the question that keeps me up at night and right now, I don’t know.”
