Re: “Barbosa's Express opens today on Oak”
This is Chelsea, the owner of Barbosa's Express in Kansas City. First and foremost, thank you to Jonathan Bender for writing such an amazing article and shedding positive light on such an important day in my life. I can't wait for you to stop in and I hope you enjoy your dining experience!
Secondly, to everyone who commented - I may know you or may not, but I appreciate you taking a stand for my restaurant, my family and the Barbosa's Restaurants. However, I strongly encourage you not to engage in this anymore. It doesn't matter what you say, Joley Wiley felt wronged and your comments won't change that, but I greatly appreciate your stance.
Now....lastly, and hopefully from here on out - we can put this "feud" to rest. I will tell the story from my side and you all may take it for what it's worth and believe it, or you can choose to believe Joley and continue to support her story here.
So what happened - I was searching for equipment on Craigslist about 2 months ago, and saw an ad on there from a local artist (Joley) stating that she paints on the side, truly loves it, and would love to be involved in creating artwork with local business owners (not verbatim, but something along those lines).
As I was approaching the opening of Barbosa's Express in Kansas City, I was intrigued and thought it would be unique and stand out to have some lovely paintings done for the walls in my restaurant. I decided to contact Joley and over the next couple of weeks, Joley and I exchanged calls, e-mails, and texts discussing and coming up with ideas which we were both excited about.
Finally, we came to an agreement that she would do 3 paintings for me - 1 of our delicious tacos, 1 of the amazing nachos, and 1 of the chips and variety of dips. Simple as that - Joley began working on these paintings and would send me updated pictures and request feedback, so we talked quite a bit during this process which was nice and I enjoyed having a say in how they were to look.
After she had 1 or 2 of the paintings done (can't remember, but I could look through my e-mails if I wanted to), she requested some money down, which we had not talked about in the beginning. At this point, I was not opposed but I wanted her to know that was never talked about upfront. We came to an adult agreement that I would give her $500 down and when the paintings were finished, she would deliver them and I would give her the other $250.
So - she comes down to the restaurant and I let her walk out my front door with a $500 check which I have the copy of and she cashed immediately.
To clarify at this point- she has $500 of my money, and I have no paintings.
Anyway - she finishes the beautiful paintings and brings them several days later. My family all loves them. I love them. We chat. I hand her another $250 check, she walks out the door and that was that.
Deal was complete on both ends. Happy happy!
K, so then my aunt Angie Ransom (owner of Barbosa's Mexican Restaurants) comes to check the restaurant out, sees the paintings, loves them and I convince her these would look beautiful at the restaurants in St. Joseph (sending Joley business and praising her). Angie decides she wants some paintings - so I get ahold of Joley and we agree on her to do another batch of paintings - 5 paintings for $1,000. Good deal on my end, and a good deal on hers - both small business owners trying to make it in this world.
A few days later, Joley comes to pick up money down - a $500 check upfront, which she too cashed immediately. As of now, I have paid her $1,250.00.
Joley finishes the first painting (a picture of the castle), and emails me to let me know she would not be doing another castle, because it took her "30 + hours and didn't display her true artwork" (something along those lines), so right there - the agreement was broken.
In midst of this, it is literally the same week the restaurant is opening and I am working my butt of to ensure a positive experience for my KC customers, so I explain to Joley that we can figure something out, but for now - I need the castle painting by Saturday (the 11th) because I wanted it on display for my soft opening. She agrees and does 3 more of the 5 paintings she agreed on.
She comes to bring 4 of the 5 paintings which we agreed on, and said these would be $800 and we could decide on the other after I open and things settle down. Cool, no biggie.
SO - she brings them in, and we all love them (once again), and we chit chat for a few minutes and then I say "My aunt is going to send you a $300 check in the mail Monday. Is that okay?"
Well - that was apparently the wrong thing to say, because she basically lost it, embarrassing me in front of my entire family in which I gave nothing but praise in regards to her.
After trying to calm her down, she storms off stating "she will never receive the money"....
At this point, it is what it is. Still had every intention of paying her.
Since, she has emailed me to tell me she is suing me for "Copyright infringement" and many other things. I decided to give her my attorney's number in case she decided to precede.
Meanwhile, there are texts exchange and they weren't healthy by any means. I made a rude comment about how she is "crazy" and I am "embarrassed for her husband" - I shouldn't have said those things, but in the heat of the moment - it is what it is. I can't take it back. I can only move forward.
Anyway - I sent a check Monday evening of the remainder $300, as well as an email stating I had sent it and an apology for the hurtful things I had said.
So, at this point - Joley Wiley has completed 2 batches of paintings for the Barbosa's Restaurants. She has been paid in full for both.
In my opinion, this is done and has been put to rest.
The paintings will be removed and not showcased at either restaurants.
Joley - You may keep the money Barbosa's Restaurants has paid you in full for. I wish you well in your future aspirations with your artwork, and greatly respect all of the painters out there.
