This came in late Friday. A grand jury indicted Eria Doss, Michael Gunn and Larry Marshall in the murders of Justin K. Budreau and Andrew J. Eli.
The grand jury's indictment ups the charges against Doss and Gunn to
first-degree murder. News reports have described the killings of Budreau, 24, and Eli, 23, as
"execution-style."
Jackson County prosecutors previously charged Doss, Gunn and Marshall with two counts of second-degree murder, two counts of first-degree robbery and four counts of armed criminal action.
Doss and Gunn also face four counts of armed criminal action and two counts of first-degree robbery. Marshall is charged with two counts of second-degree murder, four counts of armed criminal action, and two counts of first-degree robbery.
Budreau was visiting Eli at his apartment in the 1300 block of East
59th Street. The two had been friends since attending Mill Valley High
School in Shawnee.
Gunn, Doss and Marshall allegedly stole Eli's and Budreau's laptop computers, wallets and cell phones along with a small amount of marijuana.
Court records say officers found the door to Eli's apartment building
wide open
when they arrived at the scene around 1:55 p.m. on April 18. They found Eli and
Budreau lying face down on the living room floor with gunshot
wounds to the back of their heads. Eli died at
the scene, and Budreau died at a local hospital.
Court records say Doss, 19, and Gunn, 17, asked Marshall, 20, where
they could "buy some good weed." Marshall told them the "white boys" on
the block had good
weed. Marshall told detectives that he took the men to the house but no
one answered the door. The door was unlocked so the men went in.
Marshall told detectives that he went up the steps but stopped. Doss
and Gunn went into the apartment. Marshall's cousin, Carolyn Hunt,
picked up him -- and minutes later, Doss and Gunn -- and they left the
scene.
Doss told detectives that Gunn
forced Eli and Budreau to lay face down on the floor and shot them as he was searching the apartment.
Gunn told detectives that Doss shot
Eli and Budreau and changed his story several times but
never admitted shooting Eli and Budreau.

After he admitted that he stood by and did nothing while Gunn killed two innocent men? There's NO WAY he's going to be set free. Even if he doesn't get convicted of first degree murder, he will be convicted of second degree murder. You better get used to not seeing your boy around, because if he's not executed then he will be locked up for a VERY long time...hopefully until he dies. I don't wish death on anyone, but that's just reality. And I'm glad, because we don't need heartless people like Doss (or Marshall, or Gun) walking around free.

According to the Jackson County Court records the arraignment hearing for these three is June 1 at 9:30 am 2nd floor of the Circuit Courtroom. The posted Court records have not updated the charges from 2nd to 1st degree murder (yet) for Gunn and Doss.
