A palm print and a cell phone call led police to make an arrest in the death of Montague K. Ashline, who was fatally shot near 36th and Main back in June.
Jackson County prosecutors charged 45-year-old Elbert J. Holly today with second-degree murder and first-degree robbery.
Police found Ashline suffering from a gunshot wound to the chest near 10 W. 36th Street around 12:13 a.m. on June 24. Ashline was pronounced dead at the scene.
Court records say a palm print on the glass of the lobby area was
traced back to 36-year-old Paul McDaniel, who told police his version of what happened the night of Ashline's death.
According to court documents, McDaniel told detectives on Tuesday that he,
Holly and 33-year-old Diamond Blair were planning "a lick" (a robbery). The three waited at the Alps apartment complex when
Ashline rolled up, parked and went inside the apartment. When Ashline returned to his vehicle, Blair ran up to him with a .38 revolver and ordered him to
stop. Holly and McDaniel ran up behind Ashline to stop him from
running.
Ashline put his hands in the air and said he didn't have anything, but
Blair shot Ashline, McDaniel told police. The bullet went through
Ashline and struck McDaniel in his left arm. Blair ran, and Holly tried
to help McDaniel.
Holly used a cell phone to call someone at an apartment complex
behind the Burger King at 35th and Main. McDaniel told police that a
woman gave him a ride to Truman Medical Center.
Court records say surveillance video from the Alps Apartment complex
showed the robbery and killing. The probable cause statement also says
that police found out that Ashline was on his cell phone at the time of
the attack, but investigators didn't recover the phone at the scene.
Investigators traced a call made on Ashline's phone after his death.
Blair was arrested on July 5, McDaniel told police. The probable cause
statement confirmed that Blair was arrested and a .38 revolver was
recovered. Case Net says McDaniel was arrested for first-degree assault
and armed criminal action in May.
Holly was arrested on Wednesday. He denied involvement in the homicide and requested an attorney.
In 1995, Holly pleaded guilty to felony unlawful use of a weapon and was sentenced to four years in prison.
Back in June, police released these photos, which they said showed "persons of interest."
