Philip N. Earle, 27, has been charged with five counts of second-degree statutory rape after the mother of his alleged victim found out the girl was approximately seven weeks pregnant.
Jackson County Prosecutor Jim Kanatzar filed the charges after Earle allegedly admitted to a recurring tryst with the girl. In interviews with police, both the alleged victim and Earle told detectives that no contraceptives had been used. The police report states "there was no physical force used during the intercourse."
In his statement to police, Earle said that before the first alleged incident, he thought the girl was "16 or 17." Before the second incident, he allegedly learned that she was 14-years-old.
Earle told police he thought the unborn child might be his.

Here is the Missouri Revised Statute that Earle allegedly violated -- hence the charges of statutory rape:
566.034. 1. A person commits the crime of statutory rape in the second degree if being twenty-one years of age or older, he has sexual intercourse with another person who is less than seventeen years of age.
The police report states "there was no physical force used during the intercourse."
If that's true, then this man should not be charged with a crime. Statutory rape laws are absolutely ridiculous when they go as high as 16. The police and prosecutors should be allowed to use their discretion in cases like this, just like they have the discretion to charge 14 year-olds as adults. If they can be considered adults when they choose to commit a crime why can't they be considered adults when they choose to have sex?
