A mistrial has been declared in the murder trial of 18-year-old Eria Doss. Prosecutor Dawn Parsons sought a first-degree murder conviction against Doss for the killings of Andrew Eli and Justin Budreau on April 18, 2009.
The trial, in which no witnesses testified for Doss' defense, lasted all day Tuesday in Jackson County Circuit Court Judge Jay Daugherty's 5th floor courtroom. The jury's deliberations went until 10 p.m. last night, when they reported being 11-1 in favor of a verdict. It's unclear what issue was the cause of their indecision. Deliberations were halted just after 3:30 p.m. today.
Officer Brian Arant was the first Kansas City Police Department officer on the scene the day of the homicide. In his testimony in on Tuesday, Arant said he could hear the sound of breathing coming from the living room of Budreau's apartment at 1319 East 59th Street.
Eli and Budreau were "face down ... with their noses in their blood, trying to breathe," Arant said. Each had been shot in the back of the head.
Eli died at the scene, and Budreau was pronounced dead at an area
hospital.
Doss was arrested April 20, 2009. When detective Robert Blehm
questioned him in connection with the homicides, Doss confessed that he
went to Eli's apartment with two other men, Larry Marshall and Michael
Gunn, because Marshall said the "white boys" had good weed and
wouldn't be armed. Doss knew Gunn had a gun, and it was probably loaded,
he said.
"He wasn't supposed to kill 'em," Doss can be heard
telling Blehm in the videotaped interview. "That's what I was saying,
because they know the dudes wasn't gonna have no gun or nothing. I was
like, you don't need to kill 'em. Just scare 'em, cuz. That's all you
gonna do. That's all you need to do, cuz."
Marshall waited outside while Doss and Gunn entered the building through the unlocked front door and went up the stairs. Eli and Budreau were
hanging out on the couch in Eli's living room with the door open. Doss said Gunn ordered the men to lie face down on the floor while Doss
searched an adjacent bedroom for weed. He said he found a small sack and was on his way out
of the bedroom when the sound of two gunshots made his
ears ring. Doss took off down the stairs, followed by Gunn, who thrust a
laptop he'd stolen from the apartment into Doss' hands as the men struggled to
open the building's front door.
Doss told Blehm that after the murders, he, Gunn and Marshall ran to Marshall's cousin's car at 59th and Paseo. The cousin drove the boys to the Landing Mall, where they tried to sell the stolen laptop to a guy who buys electronics. The guy wasn't interested, so they went to a gas station and bought rolling papers, a lighter and cigarettes. Doss stopped by his cousin Danielle Williamson's house and sold her the laptop for $150. Then he went back to his family's barbecue at Seven Oaks Park, where he'd started out his day. "I chilled," Doss told Blehm, "drunk some Remy, and smoked, and I ate some barbecue."
Blehm told the jury that, before beginning his questioning, Doss had to sign a Miranda waiver stating that he understood his rights. But Doss
struggled to read the compound words on the waiver, so Blehm said he read the waiver out loud to him.
At the end of his confession, Blehm asked Doss if he had anything else to say. "How long am I gonna be down here?" Doss asked. Justin Budreau was rushed to a local hospital after being shot.
Prosecutor Parsons urged the jury to find Doss guilty of first-degree murder, which carries a mandatory sentence of life without parole. It didn't matter whether Doss or Gunn pulled the trigger, she said, because Doss' presence in the victims' apartment is what made the robbery-turned-double-homicide possible. Eli and Budreau were "young, healthy men," Parsons said. "One person walks in, [the victims] are not getting on the ground. You need a show of force. You need two people."
Parsons pointed out that Doss "kicked it" with Gunn and Marshall for the rest of the day, and didn't seem troubled by the act they'd committed. "Who got shot first? We don't know, but the other one knew what was coming," Parsons said of Eli and Budreau. Meanwhile, Doss and his friends "go to a party after executing two people."
Doss' public defender, Megan Roth, asked the jury to find Doss guilty of second-degree murder, arguing that the case lacked evidence that Doss planned to commit both the robbery and the murders. The victims' family and friends laughed out loud when, in her closing arguments, Roth said, "The state wants you to take into consideration his lack of remorse. He was honest. What is remorse, when you're 17 and you just witnessed a trauma like this?"
At the end of her closing arguments, Parsons broke down in tears as she described the pain that the Eli and Budreau families will feel for the rest of their lives. "I'm not a crier," she told The Pitch later. "My co-counsel was shocked."
Outside the courtroom, Doss' aunt, who didn't want to give her name, told The Pitch that Doss had been a good kid until he started hanging out with bad influences. "I'd never think of him pulling the trigger," she said. When asked whether she thought it made a difference that the victims were white and the defendants are black, she shook her head. "I don't put nothing past none of these kids nowadays. It could just as easily been vice-versa."
Speaking of the victims' mothers in the courtroom, Doss' aunt said, "I'm sorry the women lost their child. There's so much I want to say to them, but I don't know how they'd take it."
A new date has not yet been set for Doss' retrial. Gunn's trial is scheduled for September 20. Marshall will be tried October 4.

My opinion on this case is that they know what there plan was... I do hate when family's start pointing fingers at each other. The victims are gone and the family's are the ones that have to deal with the pain every day of there life. I was raised in the ghetto and I have much respect for people.I don't think they were raised to be killers but if u come from the ghetto your out look on life is different. Actually I worked in the correctional facility for a year while he was incarcirated, and between Doss and Gunn, with out a doubt Gunn pulled the trigger I seriously think Doss when he came in to jail was a silly playful kid and just wanted to rob these guys for weed, due to the bad influences he was around.
