Beautiful, naked breasts are fine things worth fighting for. This morning, the Missouri Association of Club Executives along with 16 other adult business owners, stores, and dancers filed a lawsuit in Cole County court to stop a bill banning nude dancing and alcohol sales in the Show-Me State's strip clubs.
The suit, which names Missouri Attorney General Chris Koster as defendant, is two-pronged, a) attacking the legislation's constitutionality and b) claiming the legislation was passed improperly because lawmakers refused to do a proper fiscal review.
"The first thing is obviously the First Amendment
challnge to the bill, and that is that the bill suppresses freedom of
expression during certain hours and in certain means that are
unconstitutional," says adult business attorney Dick Bryant. "The second part we've challenged is that the bill was
enacted impropertly because they failed to do the fiscal review
required by the state of Missouri, and that argument is actually in two parts. The first part of it is that they
didn't do the fiscal review, the second part is that they will be
spending tax dollars improperly by having to enforce this if it is sustained as being legitimate. The other part is that the fiscal review that was available didn't recognize that there's going to be a $4 million dollar hit to
taxpayers if the bill is sustained.
"We're hopeful the court will say 'Try
as you will to regulate adult businesses, you have to do it right but
you haven't done it right.'"
If you read my June feature on the fight over adult businesses,"Exit Boobies," you already knew that this fight was going to come down to the bill's economic impact and constitutionality. Litigation can be long and costly though, and if the bill was enforced, club owners say they'd be forced to shut their doors. So the adult industry has also filed a motion for a preliminary injunction that would keep strip clubs operating with nudity and liquor until the courts can settle things.
"Whether we schedule a hearing, that is still under discussion with the attorney general's office," Bryant says. "We asked them before if they would agree to a non-enforcement agreement while we pursue our suit, and they said they'd explore it. So they have to decide if they're going to agree to non-enforcement or we'll be going for a preliminary injunction hearing in the next 18 days."

Why is it, all of a Sudden these Clubs are a problem, but they weren't say 10 - 15 even 20 years ago ?? Why Now -?
