Johnson County District Attorney Steve Howe has a decision to make. Will he pick up where Phill Kline left off and continue the investigation of Planned Parenthood?
The Kansas Supreme Court has kicked the 107-count criminal case against Planned Parenthood back to Johnson County District Court for more action, the Topeka Capital-Journal reported. So the case can go forward but with some restrictions "on the testimony of several potential witnesses and limits on what documents
they can be ordered to produce."
The state high court was asked to decide whether Johnson County District Court Judge Stephen Tatum made a mistake in quashing subpoenas from Shawnee County District Court Judge Richard D. Anderson, Topeka attorney
Steven W. Cavanaugh and employees at the Kansas Department of Health
and Environment.
"Although the issues before us are simply summarized, their resolution is not because they arise in a complicated factual and procedural context, revealed in fits and starts over the life of a series of cases," Justice Carol Beier wrote in the unanimous decision. "Like icebergs, the appearance of the issues above the waves is relatively benign; their mass and shape below the waves goes unnoticed or ignored at peril."
So what's it going to be, Steve? My guess is he'll say he needs to review the case before he makes a decision (which is what he told me during his race with Rick Guinn for the office "... that case will be evaluated along with all of the other cases when I become
district attorney.").
