The court martial of HIV-positive Air Force sergeant and swinger David
Gutierrez is under way. The case is expected to end Wednesday, according to the Wichita Eagle, and the trial has seen several women testify.
Gutierrez,
a 20-year military man stationed at
McConnell Air Force Base, is accused of his own personal version of
don't ask,
don't tell for not disclosing to the men and women he was fooling
around with that he was possibly screwing them for life.
He's facing charges of aggravated assault, violating an order to practice safe sex, indecent acts. and adultery. He was diagnosed HIV-positive in 2007.
According to the Eagle's reports: Women testified that they wouldn't
have had sex with Gutierrez had they known he was HIV-positive. One
woman testified that she and her husband swapped partners with Gutierrez
and his wife on New Year's Eve in 2009. Beforehand, her husband "asked
point-blank if there was anything to be concerned about in that
regard," referring to sexually transmitted diseases.
Gutierrez wore a condom during sex, and she has since tested negative for
HIV.
Another woman testified that she had bareback sex with Gutierrez at a
toga party at a La Quinta hotel in 2009. They did it again at
Gutierrez' home a week later and during a camping trip. And this will

Later, a mutual friend contacted her through Facebook andtold her she needed to be tested for HIV. She said she asked Gutierrez
about whether he was HIV-positive, and he told her it was his brother
who was HIV-positive, not him.
The woman said she never would have had sex with him if she had known,
having watched a brother die of AIDS.
The woman said she tested negative three times for HIV.
Another woman testified that she gave Gutierrez oral sex and later had
intercourse with him at a hotel, believing that he was disease-free.
"I had no reason to doubt him," she said. "Naive of me,Even more women testified. One told the court that Gutierrezbut . . . "
couldn't rise to the occasion (lucky for her).
From the reports so far, it sounds like none of Gutierrez' partners
have tested positive for HIV.
Two reportedly "laughed loudly" when asked if Gutierrez' wife objected
to Gutierrez having sex with other women.
"Are you seriously asking me that?" a man reportedly asked, adding that
Gutierrez' wife wanted others to sex her husband.
In August 2010, the Smoking Gun reported that the Air Force Office of Special
Investigations started asking questions after receiving a tip that
Gutierrez had "engaged in numerous, unprotected sexual acts ... over the
course of
three years."
Gutierrez' wife, Gina, told investigators that her
husband "began
having unprotected sex with numerous partners" after being reassigned to
McConnell in 2008. He'd arrange the hook-ups through adult networking
websites and "bragged" to her "about his numerous sexual exploits in
the Wichita area and commented he never informed the other parties of
being HIV-positive."
Two women are listed in the court
documents as claiming to have had sexual encounters with Gutierrez after
meeting him on adult websites. A woman from Winfield, Kansas, claimed
that she met Gutierrez at a swinger
party after chatting on adultfriendfinder.com. The 44-year-old woman
told investigators that she went down on Gutierrez while he took
videos and photos at several parties.
Another woman,
also 44, met Gutierrez on clubforeplay.com and "engaged in unprotected
oral sex and
vaginal intercourse" with Gutierrez at his Wichita home. But she said he
never
told her that he was HIV-positive.
The Smoking Gun reports that, on one of his adult profiles, Gutierrez
listed "honesty" as one of the
qualities that he was looking for in a sexual partner. He also posed
this question on a separate post: "Why are people
scared of the HIV virus,
don't you wear condoms to protect yourself from HSV?" and "The
research I have done raises several questions on weather or not HIV is
even related to AIDS." Seems like a defensive post to me.
According to court records, investigators seized from Gutierrez a "blood
chemistry
report," cockrings, nipple clamps, condoms, vibrators, dildos and a
collection of porn videos with titles such as The World Sexiest
She-Males, Cum Cravin' Cowpie Cuties, Strap-on
Valley Bitch, Mature Muffs, Transsexual Divas 8, The
Biggest Black Cocks Ever, and Double Dickin' Supersluts. They
also took 146
pages
of "HIV related research articles."
Let's hope the government gives Gutierrez back his condoms. If
this is all true, he needs 'em.
