Felons can't hold office in Missouri. It's a pretty simple premise. So Republican Herschel
Young's victory as
presiding commissioner of Cass County last November has been thrown out by a judge.
Young had been banned from taking office because he pleaded guilty in 1995 to a Class-C felony for slugging a
guy, who he claimed spit in his wife's face. Young received probation. But a skeleton has popped out of the closet and will keep him out of office.
The Star reported that Cass County Prosecuting Attorney Teresa Hensley
had sued when Young took the oath in January. Young, as he's been prone
to do, claimed it was "political." Circuit Judge Jacqueline Cook
reportedly disagreed.
"However, we are a republic, governed by our elected officials and by
the laws that are passed by elected officials in the public's interest,"
Hensley wrote in her opinion.
Of course, this was just red meat for Young. "We're going all the way to
the U.S. Supreme Court," he told the Star.
I'm sure the high court has nothing better to do than hear a case from a man who already has a new assault charge pending against him for supposedly throwing a teenager to the ground and trying to kiss him.
Last June, Young allegedly assaulted a teenage boy who was
kissing a
teenage girl at the Fun Run Mud Run truck race in Garden City.
Prosecutors allege that Young grabbed the
teen by his head and arm, tried to kiss him on the mouth, and then threw
him down on the ground. Why would Young do such a thing?
Young told the Star
that he's friends with the girl's
father and wanted to embarrass the boy. He has also given conflicting
statements in reports, admitting that he threw the boy down and tried to kiss
him and later denying it, claiming that the accusations were fabricated and
politically motivated. What kind of country do we live in that a 43-year-old man can't (allegedly) beat up a teenager and try to kiss him? That's not the America that I know and love.
