Gay sex is still illegal in Kansas, and lawmakers won't do anything about it

Kansas' progressive nature never ceases to amaze me. In a state where you still cannot buy full-strength booze at grocery and convenience stores -- 84 years after Prohibition -- you still cannot legally engage in gay sex. And to absolutely no one's surprise, Kansas lawmakers aren't about to repeal the law -- even though it's unconstitutional, the Topeka Capital-Journal reported.

Kansas' sackless leaders on the House Judiciary Committee -- both Republicans and Democrats -- reportedly are cool with letting the statute stay in Kansas' rule book, even though the U.S. Supreme Court struck down a similar law in Texas in 2003.



Reps. Lance Kinzer (R-Olathe) and Jan Pauls (D-Hutchinson) told the Cap-Journal that they thought a repeal of the sodomy statute was unnecessary because it's "unenforceable." From the Cap-Journal:

Kinzer said the sodomy statute wasn't being enforced in

Kansas and there was no evidence homosexuals were being threatened by

police officers with arrest under the law.

"It's a tempest in a teapot," Kinzer said. "I don't think it would make

any difference. The statute is unenforceable."

Except that the existence of the law at all is a symbolic disrespect for gays and lesbians. But, hey, if it's anything besides scheduled missionary-position sex on a Saturday night, then I'm sure Kinzer disapproves.

Thomas Witt, state chairman of the Kansas Equity Coalition, called for both lawmakers to be ousted from their leadership positions.

"Rep. Pauls' endorsement of an unconstitutional statute that's used to threaten and discriminate against law-abiding Kansas citizens is an outrage," Witt told the paper.



Really, would anyone expect anything less in Kansas?

They are very willing to cherry pick the bible for their causes but do not bring up the rest of it where it applies to them.
But they will be judged not by the death of Christ but by the very law they choose to follow. Christ said so. God said so.
What amazes me is the those in the GLBT still vote by a large majority for Republicans who prove over and over their hatred for them except during the elections.

It would cost MORE money for someone to have to fight the law in court because some idiot came along and tried to enforce an unenforceable law. It wastes the court's time. We shouldn't be passing unconstitutional laws in the first place. But when we do, we should correct the mistake as soon as possible.

The difference it makes it that, like in Texas, eventually some idiot will waste resources trying to enforce it and force some poor individual or couple to go to court over the issue, wasting the court's time and resources. Why not prevent that by getting it off the books?

If you don't like gay people, you don't have to associate with them, so what's the issue and why do you protest so much? When did "open minded" mean you couldn't have morals?

Laws matter whether they are enforced or not. Or would you be okay with a law that said the practicing Christianity was illegal? I'm pretty sure most people would be vitriolic in their anger over such a law, even if it wasn't being enforced?

As I said before (and I'll spell out better here), laws that have been deemed unconstitutional by the Supreme Court, must be promptly addressed by the local, State or federal government to make them constitutional or have them repealed from the books.

Also, it's "probably" not "prolly."

The issue isn't that the law is on the books, it's that it isn't being enforced. Take your faggot asses to Frisco. this law remains in the books simply because it's a topic that can easily stir the political fire come election time. i don't foresee overnight raids on the houses of buggering kansans anytime soon.

Firstly, who cares if you can't buy booze in your grocery store, that is what a liquor store is for. Secondly, some laws should just be abolished since they are not in correlation to the times. People get far too caught up in the law making system, it prevents any real progress from being achieved.

why does anybody care? it is only a problem if people get arrested for it.

if they spent time removing it then wouldn't that cost money? i am no expert on politics but im sure it would take several people some amount of time and paperwork to remove it. and they all need to be payed. this may be a negligible amount but if everybody does this for everything then we are instantly wasting a lot of money. besides wouldn't that money be better used for a school or hospital?

Laws often become outdated and unenforceable. Local and State governments used to set aside a day every couple of years or so just to remove outdated laws. However, laws that have been deemed unconstitutional (illegal laws) should be removed immediately. In fact, having such laws on the books after final decisions by the high court simply means that the State has decided that the Constitution is not important. Kansas laws are NOT above the Constitution.

Problem is the law is on the books. The police & courts have the duty to enforce the law. We tell them every day, they can't pick & choose what laws to enforce.
What if a slavery law was still on the books (I know KS was a free state)?
