Angilda was convicted in January of raping a 92-year-old Leawood woman while drunk and high on Ecstasy. The rape occurred last June, and the conviction could end up with Angilda getting an 85-year prison sentence.
Angilda's defense attorney is arguing that 85 years would be cruel and unusual punishment, according to the Star. "He's 22," Angilda's attorney Carol Cline reportedly told the court. "If there were no sentencing enhancements he's probably going to be in his 60s when he gets out. The upward departure (in sentence) means he never gets out." Uh, good.
Cline reportedly argued that the state of Kansas never did a risk assessment to see if he posed a future danger to society. She also showed why being a defense attorney must suck some days.
"She was sharp as a tack," Cline said of the woman, who managed to call 911 during the attack. "She did all the smart things she was able to do and she was not severely injured."Prosecutors aren't feeling much sympathy for Angilda, who apparently tried to call the woman from prison after his arrest, violating a
protection order
.Ornburn reportedly told the court.
The call is up to Judge Stephen Tatum, who denied a defense motion for a new trial. He'll decide on April 19; Angilda's sentencing is scheduled for May 13.

Bad
news for Angilda, while trying to flee, he sucker-punched an officer,
who just happened to be the Leawood PD's "ground fighting instructor."
So yeah, he didn't last long.
Somehow, 85 years just doesn't seem long enough.
